Terms of Use
The ground rules for using cerebralbrewing.com and the Cerebral Brewing companion app. Short version: be 21+, be decent, and don’t misuse the lab.
§ 1 — Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of the Cerebral Brewing website at cerebralbrewing.com (the “Site”) and the Cerebral Brewing mobile application (the “App”, and together with the Site, the “Services”), operated by Cerebral Brewing (“Cerebral”, “we”, “us”). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
§ 2 — You Must Be of Legal Drinking Age
The Services concern alcoholic beverages. You must be at least 21 years of age (or the legal drinking age in your jurisdiction, whichever is greater) to use the Services. We do not direct any content at persons under the legal drinking age. Please enjoy our beer responsibly — and never drink and drive.
§ 3 — Accounts
Some features (memberships, check-ins, saved beers, notifications) require a free account, created with your email address or a third-party sign-in. You are responsible for the accuracy of your account information and for anything that happens under your account — keep access to your email secure. You may delete your account at any time in the App (Settings → Delete account) or by emailing [email protected].
§ 4 — Memberships
Paid membership programs (Study Club and Endeavor) have their own program terms, available at Membership Terms. Those terms control if they conflict with these Terms for membership matters.
§ 5 — Purchases & Third-Party Services
Merchandise sold through the Site is processed by our commerce provider (Shopify); membership purchases may be processed through third-party platforms noted at checkout. Purchases made at our taprooms are governed at the point of sale. Third-party services linked from the Services (including payment processors and social platforms) have their own terms and privacy practices, which we don’t control. All beer is sold and served only where and as Colorado law permits.
§ 6 — Your Submissions
The Services let you submit content — for example contact and inquiry forms on the Site, and photos, notes, and check-ins in the App (“Submissions”). You keep ownership of your Submissions, and you grant Cerebral a non-exclusive, royalty-free license to host, display, and share them within the Services in connection with operating and promoting Cerebral. Don’t submit anything unlawful, infringing, hateful, or harassing. App community posts are additionally governed by the community guidelines shown before your first post; we may remove content or restrict accounts that violate them, and you can report or block content and users in the App.
§ 7 — Acceptable Use
You agree not to misuse the Services: no unauthorized access attempts, scraping at disruptive volume, interference with other users, misrepresentation of your affiliation with Cerebral, or use of the Services to violate any law.
§ 8 — Our Content
The Services and their content — names, logos, label art, photography, text, and software — are owned by Cerebral or our licensors and protected by intellectual-property laws. We’re flattered if you share it; don’t use it commercially without our written permission.
§ 9 — Disclaimers
The Services are provided “as is” and “as available.” Tap lists, release schedules, hours, and availability change frequently — a beer being listed is not a promise it will be on tap or in the cooler when you arrive. To the fullest extent permitted by law, Cerebral disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
§ 10 — Limitation of Liability
To the fullest extent permitted by law, Cerebral will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of $100 or the amount you paid us for the product or membership giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
§ 11 — Changes to the Services or These Terms
We may update the Services and these Terms from time to time. When we make material changes we’ll update the date below, and for significant changes affecting members we’ll make reasonable efforts to notify you. Continued use of the Services after changes take effect constitutes acceptance.
§ 12 — Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute arising under these Terms will be brought in the state or federal courts located in Denver, Colorado.
